Pension Plan Services
Novara Tesija, P.L.L.C. handles all aspects of plan design, including document creation and filing, applying for an IRS determination of tax exempt status, maintaining plan documents to ensure continued qualification of tax exempt status, and drafting participant communications. Our firm advises trustees regarding their duties as fiduciaries and ensures that they act within the boundaries of the law. We also assist with drafting summary plan descriptions, summaries of material modification, determination letter applications, annual funding notices, and other documents required by law. On behalf of defined benefit plans, we advise on matters involving withdrawal liability, underfunded liabilities, and audits conducted by the Department of Labor.
We have successfully guided our pension plan clients through many Department of Labor audits, both special and routine, and we can provide advice on any other compliance issues that may arise. For participant directed plans, our lawyers assist trustees with compliance issues relating to qualified-default-investment alternatives (QDIA), which helps to insulate trustees from breach of fiduciary duty claims. We also review and process QDROs in a diligent and efficient manner. Our firm can also advise a plan and its Trustees on matters involving legal concerns related to real estate and commercial investments, including private placements and alternative investments.
