Novara Tesija P.L.L.C. is fighting to reduce healthcare costs in federal courts on behalf of several clients - including the Michigan Regional Council of Carpenters Employee Benefits Fund, the Abatement Workers National Health and Welfare Fund, and the Monroe Plumbers and Pipefitters Local 671 Welfare Fund.

In one nationally watched lawsuit against the insurer Blue Cross Blue Shield of Michigan ("BCBSM"), Novara Tesija is serving as one of the co-counsel. The substance of the allegations in the lawsuit, which follows a lawsuit filed by the United States and State of Michigan governments, is that BCBSM entered into agreements with hospitals throughout Michigan giving BCBSM a competitive advantage over competing insurers, in exchange for rate increases which were passed on to health and welfare plans and consumers. These agreements required hospitals to charge BCBSM's competing health insurers at least as much (through equal-to MFC agreements), or more (through MFN-plus agreements) than those hospitals charged BCBSM for the same services.

This practice has had the effect of increasing the costs of health care for all non-BCBSM health insurers and insureds, as well as deterring competition in the Michigan health care market. This case is currently in the initial stages. On June 7, 2011, the Michigan federal court denied BCBSM's motion to dismiss the federal and state actions.
